Businesses require a lot of functions in order to run properly and efficiently. Different applications a put in place in order to remain in proper working order, this not only means operational but judicial as well. The need for law in business will help keep the businesss ethical and moral values in regulation according to the laws established for the state and the governing business agencies. There are many contributions to the need and identifications of the laws that are put in to place for a business, but there is a role that was put in place from the United States Constitution and the significance was powerful.

The Constitution of the Unites States was the foundation of the basic principals or functions of the federal government. All basic or fundamental functions were put in place to oversee a specific measured “standards” that the founders were sure were needed in order to remain a legal and fair government that was protective to the rights of the people, this holds true for the laws for businesses in regards to the rules from the constitution. (The U.S Legal System, 2011)

There are many clauses and amendments in the constitution that are particularly interesting in regards to business laws and regulations. Article 1, section 8 for example is the clause that states, “The Congress shall have Power to lay and collect Taxes, Duties, Imposts and Excises, to pay Debts and provide for the common defense and general Welfare of the Unites States; but all Duties, Imposts and Excises shall be uniform throughout the United States”. (The U.S Constitution, 2011) This clause means that congress can affect businesses by imposing taxes needed for sales and products from that particular business. This means that businesses have to abide by laws put in place in order for them to remain in business even if they do not agree with the amount of taxes they will pay for their particular business. Congress has the authority for this under the constitutional guidelines to regulate the products sales regardless if it is in the state, being shipped, or being bought for resale. This clause has a great impact on business probably more so than any other clause because it forced businesses to be more responsive to adherence to the regulations needed for a lawful business, the protection of the business itself and the consumer affected by the business.

Another amendment that is significant in this case would be amendment 5, ” nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.” (The U.S Constitution, 2011) In this regard a business
