EXECUTIVE SUMMARYI have worked as an Intern Trainee/ Project Trainee for the Employee Relation Division of the Human Resource Department at Toyota Kirloskar Motor Private Limited from 03.07.2017 to 24.08.2017 Although, my internship project is entitled as Organisational Study of Toyota Kirloskar Motor Private Ltd., I was engaged in multiple tasks of this division throughout my tenure of internship which is related with industrial relation and labour laws followed within India. Task of the Activity:Preparation of non-compliance report for contractors and sub-contractors of TKM.Analysis of the compliance level of contractors.Issuance of show-cause notice in case of failure of compliance by contractors and sub-contractors.Attend domestic enquiries seating conducted inside and outside of TKM premises.Often act as a domestic enquiries coordinator i.e. record the communication of the domestic enquiries. Purpose/Objective of the Activity:The purpose of this study is to know what all areas of labour laws are mostly non-complied by the contractors and sub-contractors at TKMAreas of labour law include the following laws: Employee Provident Fund and Miscellaneous Provision ActContract & Labour (Regulation & Abolition) ActEmployee State Insurance ActMinimum Wages ActKarnataka Shops & Commercial Establishment ActMaternity Benefit ActBonus ActGratuity ActEqual Remuneration ActKarnataka Industrial Establishment (National & Festival Holidays) ActKarnataka Labour Welfare Fund ActPayment of Wages ActTo know about what are the various domestic enquiries being conducted in TKM for the misconducts reported as a part of Disciplinary Management.To know about the basic and important steps taken while conducting an domestic enquiries.Methodology:The reports have been prepared based on specific formats set by the management of TKM. The Contractors Non-Compliance Audit Report 2016-17 has been further analysed for 2 consecutive audit reports of Nov-Dec 2016 and Mar-Apr 2017. The base for preparation of all these reports are the Audit Reports of each contractor audited by BCP Associates- Auditing & Consulting Services. As far as the domestic enquiries are concerned the steps are not same for all domestic enquiries officers.Expected Learning:To gain knowledge about employee relation activities.To understand labour laws applicable to Contract Labour Management in an IndustryTo know about various provision related to labour laws, FORMs, Section/Rules and Risk Mitigations StrategyTo understand the basics of domestic enquiries proceedings initiated against a Misconduct to maintain the discipline in the organization.TimelineActivity to be completed within 1-month duration. Activities includesInforming the contractors about the non-compliance of labour lawsCompare of the non-compliance between the month of November-December 2016 and March- April 2017.Analyse the risk factors involved in the non-compliance.Issuance of show-cause notice via mail and letter.INDUSTRY PROFILEThe automotive industry in India is one of the largest in the world with annual production of 23.96 million vehicles in Fiscal year 2015-16, following a growth of 2.57% over the last year. The automobile industry accounts for 7.1 % of the country’s GDP. The 2 wheelers segment with 81% market share, is the leader of Indian Automobile market, owing to a growing middle class and young population. Moreover, the growing interest of the companies in exploring the rural markets further aided the growth of the sector. The overall Passenger vehicle (PV) segment has 13% market share.
