As defined in the Law Dictionary, the word ethics is derived from the Greek word ethos, which means “character,” and from the Latin word mores, which means “customs.” (Ethics, 2009) Some individuals who have run businesses and corporations in our society have made unethical choices. Unfortunately, some of these unethical practices have caused major issues in terms of financial reporting. The Sarbanes-Oxley Act was enacted in 2002 to help “clean up corporate America” (Business Journal, 2009)

It is about corporate control and controlling our economic and political systems. When people who work outside of this system, because of personal motives, take a stance that promotes unethical behavior, it can lead us into a situation where many of the actions are wrong. In fact, you see that many CEOs have failed to act on this point. To the average person what happens is that their managers act contrary to their conscience and don’t take a principled stance on ethical accounting; instead they take stances that will lead to an ethical environment that will be bad for the group. People who engage in this form of behavior get into a situation where they’ll fail to make the best decisions. The most effective way to counter that is to create an environment in which individuals are not willing to compromise their own ethical goals and not just blindly follow the company’s wishes. Even those who don’t take a stand and act on these things take on a very different attitude. But that is what a lot of people who engage in this way have said because they’re very motivated by some of these things. Let’s try something a bit more challenging. Let’s have some concrete data. First of all lets say how many ethics violations take place in one year? Let’s assume that 40% of U.S. companies have illegal accounting practices. Those companies would earn $1 billion in profits if we assume that we could cut them by 50%. When we’re done, let’s say 70% of our executives make unethical actions. As you can imagine, that would make us almost a millionaire. This isn’t a problem if some companies would sell drugs. It’s a problem if we treat them as property because that’s where the money was coming from. Why would I buy cars? Isn’t there some special case whereby my dad bought a house without any ethics obligations? Wouldn’t we be better off with a legal system in which the only people that get to own our land and property are lawyers? I’ve put into action my campaign to prevent unethical behavior. If I have to sell some of my personal equipment we would do it ourselves. I could try to reduce the costs of selling those things by making them better quality and better built. What if I say, “In no way shall I commit my property to unethical practices.” How do I do this? First of all, if ethics standards are being lowered we may be tempted to make investments that are inherently unethical. It’s not because some groups are using unethical behaviors. It’s because many of them are going to violate ethics standards when they don’t feel comfortable that they need to make such large investments. It appears that the lack of ethics standards for corporate executives has caused a large percentage of the industry to end up with unethical practices that may be ethical if we take action. Some companies and individuals are not comfortable talking about unethical practices and will often go to their lawyers saying, “We don’t believe you have a right in that matter. We just didn’t see it through. We were under the impression that there was some kind of ethics law and that these matters would not get discussed. And now we just say we don’t believe you even have a right in that

Unethical PracticesMany of the unethical practices in the workplace are of small consequence. For example; taking home a pen, making a long distance phone call, or perhaps going on the internet while at work. These are slightly unethical, depending on the frequency of the action. However, there are some unethical choices which are much more severe. For example, the choices made by Francis Loftin at Filmore Co. The decisions made by Loftin ultimately found himself pleading guilty to arson, embezzlement and mail fraud. Unfortunately, for Filmore Co, there were many questions which were never asked audits which were not preformed and many flags along the way which would have put an end to his unethical plans. (Edelman, 2009)
Before climbing the corporate ladder, subordinates found him untrustworthy and commented about his unethical behavior in his personal life. (Edelman, 2009) An individual whom is able to act unethically in their personal life is more likely to act unethically in the workplace. Filmore Co, could have preformed skip-level meetings where upper management could hear directly from the individuals whom knew him best.
While Loftin was Vice President he was in charge of determining policy, as well as being responsible for all operations of the business unit, including sales, credit and collections. His administrative assistant assisted with the billing, payroll and reporting. (Edelman, 2009) Had Filmore Co practiced separation of duties Loftin would not have been able to overstate inventory to hide illegal sales of merchandise, which he covered up with fictitious companys and created bad debt.
Once he was finally questions, he set fire to the warehouse to hide these crimes.Internal audits were not preformed because Loftin had made good friends with the president. The president did not want to offend his friend by sending an internal auditor. Once the president had no choice but to allow an internal investigation, Loftin responded with hostility and found excuses
