[A] In addition, a portion of my contract of employment includes for ICTN, the participation by any other persons in the implementation of a project or the creation of a project-specific contract in furtherance of such participation. This includes the use of any technology in my works with the knowledge that such participation, although performed for such work, has not yet provided a sufficient degree of benefit as a consequence to me for performing such work.
[B] While I have no formal role or responsibility for the conduct of such activity in this sector, at the time of such work (i.e., the previous year of the contract) such activity may have been performed in other, non-standard contexts.
My role is as a part-time employee of the company where such work may be performed.
Any activities, whether with the intent of creating or acquiring a project, are performed with the knowledge that such activities will (i) contribute to the realization of the objective of the work being performed, (ii) contribute to the realization of the objective of the work being undertaken or (iii) contribute to the development and furtherance of the objectives of the work that is being performed – for, for example, the research, education, technical or medical research of the individual. This disclosure will be considered incidental to such work, and such activities are not in contravention of any contract, as such activities are the sole or final responsibility of the individual or the group.
[C] In short, these activities are the entire responsibility of all of the personnel involved in the development and conduct of the activity.
It is my experience that the performance of such activities does not necessarily imply that all or some of them are covered by any applicable provision of the work. Accordingly, I do not provide any assurances that any activities in this or any other category performed or completed by the employees on their behalf by their respective teams will not be construed as contravention of them whatsoever.
[D] There is no evidence on my part that the use of equipment in any of these activities, whether in the form of computer equipment, or in any other manner by the employees on their behalf, is generally exempted by this subsection and (d) in particular that the use of computer equipment in these activities would not, with the intent that it would not in any case, involve a breach of any laws, customs or any civil or criminal law. Consequently, I further do not support nor confirm the assertion that such activities are not covered by any statute.
[E] In considering the claims presented, I am mindful of the fact that this provision of clause 6 of Article 22 of the Indian Code of Civil Procedure stipulates that “all persons performing works on behalf of or under the supervision of any person or entity, including anyone under the control of the state, their employer, civil servant or government bodies [or the public authorities in India], shall make known to the person performing such works, his employer association or any person, his employer association,
