When you see on the news that a police officer is being charged with excessive force or the fact that someone is saying because they are black they were targeted, wonder if they ever attempt to sue or get something out of that issue? Well there are people that have been arrested unlawfully, have been searched without any reason or without the proper paperwork to do so. Many people know that police officers have a good set of powers when it comes to the law and abiding by it, but then you see cops that don’t even follow their own rules (Police Misconduct). The constitution is a simple set of rules that all should follow, whether you’re an officer, a judge, or a sheriff that works on a posse part time.

Civil rights were put into place to make sure that us as citizens were not treated unfair and that the officers of the law followed certain rules. No abuse will be tolerated and shouldn’t be, if the civil rights act was not in place I cannot even imagine what chaos would be going on in the world today (Police Misconduct). No abuse from our government should be happening, in those rights that we as citizens have no misconduct or brutality is accepted. Again, a lot of people don’t like to be stopped and questioned when it comes to crimes that they may be involved in or have been involved in previous crimes, so they act out and cause a scene in which it does cause an officer(s) to have to use force. When it’s a simple case of an officer having a bad day or because they would rather not deal with a dirt bag they choose the dirty route and use excessive force for no reason at all! Police officer has immunity, what this means is that they cannot be sued or threatened to have their jobs taken from them. If in the case they did nothing wrong that is where immunity would come into place, if they did in fact show brutality then the officer will have their punishment sent down from the dept. and dealt with accordingly. If someone claims that they are seeing the officer of the PD then they will need to show proof that they had their rights taken or that they were treated in a way that was uncalled for. In most cases it is the officer merely doing their job, but in some cases it does end in the way that no one wants to see an officer act. When talking about rights, and the people that have those rights taken; that’s when we talk about Section 1983. Section 1983 goes over all the rights that a person as a victim has and goes over officer misconduct. The section 1983 was originally brought about as part of the Civil Rights Act which happened in the year 1871. The CRA was brought about to make sure that police brutality would not have to be dealt with and laid the laws out to the officers on what was okay and what was not going to be okay. The reason that it was decided to be called Section 1983 is because it is under Title 42 of the code of the United States.
